TWAD.LY TERMS AND CONDITIONS

Twad.ly (hereinafter "we" “us” “twad.ly”) is an in-stream advertising platform that is NOT AFFILIATED WITH TWITTER INC. NOR WITH ANY OF THEIR PRODUCTS.

The platform allows advertisers to post messages (tweets) on bloggers Twitter widgets after explicit approval by the user. Advertisers will only be charged once the tweet is successfully sent to the widget. Bloggers will only be paid after the tweet is successfully sent to their widget.

 

Advertiser Participation

Once you are registered, the Advertiser agrees to the Terms and Conditions and confirms they are over the age of 18 years and have a valid Paypal account. The advertiser also agrees that their advertisements do NOT contain discriminations or defamations regarding race, gender, religion, nationality, disability, sexual preference or age. They also agree NOT to contain sexually explicit, pornographic information or statements that infringe copyright, trademark or other third party intellectual property rights. The advertiser agrees to fund their account via Paypal and pay the blogger once each tweet is successfully sent.

 

Blogger Participation

Once you are registered, the blogger agrees to the Terms and Conditions and confirms they are over the age of 18 years and have a valid Paypal account. The blogger agrees that once a tweet is offered and approved, it will be tweeted at a time convenient for the advertiser. Once the tweet is successfully sent to their widget, the blogger agrees to NOT take down or move the position of the widget. It should NEVER be moved or deleted. Account suspension without payment is the consequence of such action. Bloggers can reject any campaign offer for any reason.

 

Widget

The blogger agrees to emebed to widget on their blog, preferably above the fold. The blogger agrees that once they approve an advertisement they will NOT move or delete the widget for 24 hours (the life of the campaign).

 

Payments

Advertiser’s should fund their accounts via paypal or major credit card via paypal before offers are made to bloggers. The minimum funding amount is $25. The accepted dollar amount will be deducted (plus a pre-defined service charge) once the advertiser clicks the “pay & tweet” button in their dashboard. The blogger can request to be paid via paypal once their account balance has reached $25. Twad.ly will send payments once a month.

 

Termination

This agreement is for an indefinite term but the advertiser and blogger can terminate their account any time by emailing support@twad.ly

 

Liability

Twad.ly makes no warranty that the service will be available without interruption or delay. If there is an interruption in the Twad.ly network or process with Twitter’s API, Twad.ly shall not be held liable for any damages in respect to losses in profits or functions. The Advertiser agrees to indemnify and hold Twad.ly and the blogger from and against any claims, demands, liabilities, damages and losses, that arise from actions of the advertiser or a breach of these Terms and Conditions.

 

Data Usage

The Advertiser agrees to allow Twad.ly to store all their use data, purchase history, tweets and price as long as Twad.ly is in operation.

 

Modification of the Terms and Conditions

Twad.ly reserves the right to amend these Terms and Conditions at any time.
